By accessing or using the Aqui Aca website (https://aquiaca.com and https://app.aquiaca.com), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our website or services.
Aqui Aca is a web application provided by Reflexive Labs, LLC (“we,” “us,” or “our”) designed for tracking school attendance and for communicating with the parents, guardians, and other caregivers of students, including by text message (SMS).
3.1. You must create an account to use certain features of Aqui Aca. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.3. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.
You agree not to:
4.1. Use the service for any unlawful purpose or in violation of any applicable laws.
4.2. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
4.3. Interfere with or disrupt the service or servers or networks connected to the service.
4.4. Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another’s privacy.
5.1. The Aqui Aca service and its original content, features, and functionality are owned by Reflexive Labs, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5.2. You may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit any of the content, in whole or in part, except as expressly authorized by us.
This section applies to the text-messaging (SMS/MMS) features of Aqui Aca. Messages are transmitted through our messaging provider, Twilio.
6.1. Program description. Aqui Aca provides a two-way text-messaging service that schools use to communicate with the parents, guardians, and other caregivers associated with their students (“Recipients”). Messages sent through the program may include student attendance and pickup notifications, administrative and school announcements, replies to messages a Recipient sends to the school, and other communications initiated by school staff. Messages are sent from a phone number provisioned for the school.
6.2. Your responsibilities and consent. If you are a school or a member of school staff using the messaging features, you represent and warrant that, for each Recipient and mobile number you add to or message through the service, you have obtained all consents required and have the authority to send text messages to that Recipient, in compliance with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and all other applicable laws and mobile-carrier requirements. You are the sender of record for messages to your Recipients and are responsible for their content and for honoring opt-out requests. Providing consent to receive text messages is not a condition of purchasing any goods or services.
6.3. Message frequency. Message frequency varies and depends on the school’s activity and the events that trigger notifications.
6.4. Message and data rates. Message and data rates may apply. Aqui Aca does not charge Recipients for text messages, but a Recipient’s mobile carrier may. Recipients are responsible for any charges from their carrier.
6.5. Opt-out. A Recipient may opt out of messages at any time by replying STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) to any message. After opting out, the Recipient will no longer receive messages from that school’s number unless they opt back in by replying START (or YES or UNSTOP). These opt-out and opt-in requests are honored automatically.
6.6. Help. A Recipient can reply HELP for assistance or contact us at dan+sms@aquiaca.com.
6.7. Supported carriers. Supported carriers include AT&T, Verizon Wireless, T-Mobile, and other major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
6.8. No guarantee of delivery. Text messages are provided on a best-effort basis. We do not guarantee that any message will be delivered, delivered on time, or delivered to the intended Recipient, and we are not liable for any missed, delayed, or misdirected message. Do not rely on text messaging for emergencies or time-critical matters.
6.9. Privacy of messaging data. Mobile phone numbers and messaging consent are handled as described in our Privacy Policy. We do not sell Recipients’ mobile information, and text-messaging opt-in data and consent are not shared with any third parties or affiliates for their own marketing or promotional purposes.
Your privacy is important to us. Please review our Privacy Policy to understand our practices regarding personal information provided through our website.
Our service may contain links to third-party websites or services that are not owned or controlled by Reflexive Labs, LLC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.
In no event shall Reflexive Labs, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
Your use of the service is at your sole risk. The service is provided on an “AS IS” and “AS AVAILABLE” basis. The service is provided without warranties of any kind, whether express or implied.
These Terms shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
